New Rule Pays Overtime to Some Management Employees

New overtime regulations by the US Department of Labor which go into effect December 1st, would have employers paying overtime to professional and executive type employees who are currently exempt from overtime compensation.

At present the salary level of employees who are exempt from earning overtime is $380 per week.

But the new rule increases the salary level of overtime exempt employees to $767 a week.

There are also other conditions that employees have to meet such as their salary basis and duties.

The American Samoa Government and businesses who earn half a million dollars per year are covered under the new rule.

This means that some management and professional type employees who are not entitled to overtime now will be able to earn overtime come December 1.

Min Park of the Wage and Hour Division, Honolulu District explains that the new rule only changes the salary level of overtime exempt employees and the other conditions relating to duties and salary basis remain the same.
