
The American Samoa Power Authority has withdrawn a complaint against three people charged with taking power illegally and asked the court to dismiss charges against the defendants from Futiga.
Samoa News reports that ASPA through Assistant Attorney General Laura Garvey asked District Court Judge Elvis Patea to dismiss the charges against Michelle Aetui-Fuimaono, her husband Kirk Aab and her brother Ernie Aetui.
The three have spent the past three weeks in the Tafuna Correctional Facility after they were unable to post bond.
Assistant Public Defender Bob Stuart informed the court that the defense was ready to proceed with the preliminary examination but the prosecutor asked for dismissal.
The government told the court that ASPA and the Aetui family had reached an agreement in this case so the government was unable to continue with their criminal case.
Judge Patea acknowledged the government request and he said the court is unable to determine probable cause to bind the case over to the High Court for further proceedings, because the government did not present any evidence.
And for that reason, the case against the three defendants was dismissed.
