Committee approves American Samoan ancestry amendment

The Constitutional Review Committee yesterday approved a proposed amendment to clearly define a provision in the constitution which calls for the protection of the interests of the people in American Samoa.

The present wording in Article 1, Section III of the constitution states, “it shall be the policy of the Government of American Samoa to protect persons of Samoan ancestry against alienation of their communal lands and the destruction of the Samoan way of life and language, contrary to their best interests.”

The majority of those who expressed an opinion, supported the addition of ‘American’ so that there’s a clear understanding the protection clause applies to the people of the territory of American Samoa, or more specifically the people of Tutuila, Manu’a, Aunuu and Swains.

Opinions varied on whether this should also apply to all those who are born in American Samoa, even those without American Samoa ancestry.

And opinion also varied on whether delegates should define who is an American Samoan.

House Speaker Savali Talavou Ale proposed that a subcommittee be set up to further discuss the issue, a recommendation which was supported by Senator Malaepule Saite Moliga and several other members.

Paramount Chief Lefiti Pese was of the opinion that the traditional and cultural ties with Samoa should continue to be respected, noting that people from Samoa have served their families here. He observed that American Samoa is also home to other pacific islanders who assimilate with the Samoan way of life and culture, rather the concern is with “those from Asia.”

 

Rev. Elders Faamao Asalele and Faaitete Saifoloi also supported the amendment. Rev Saifoloi suggested that maybe a review of the name American Samoa should also be included, noting that islands are usually named by their colonial powers.

Lydia Faleafina Nomura said, while she supports the amendment she is concerned that it may discriminate against children born of American Samoan parents, outside of American Samoa.

This was also shared by youth representative Nerisa Vee.

Committee Chairman Lt. Governor Talauega Eleasalo Ale explained, that the protection clause also applies to children born outside of American Samoa to American Samoan parents.

When the issue was put to a vote, it was approved 32-22. With the change Article 1, Section III of the constitution would read:  “It shall be the policy of the Government of American Samoa to protect persons of American Samoan ancestry against alienation of their communal lands and the destruction of the Samoan way of life and language, contrary to their best interests.”

The amendments approved by the committee will be put to the Constitutional Convention which the Governor has previously announced is to be held in July.

Today, the committee will continue discussion of a proposal for further protection of communal land.
